The petitioner seeks bail in a case under Section 379 of the Indian Penal Code.

The petitioner is not named in the FIR. The name of petitioner figured in the case during the course of investigation. The petitioner confessed his guilt and in pursuance thereof one Ashraf was apprehended and from whose possession 17 bundles of cable made of aluminum wire and 15 optical fiber kept in 15 gunny bags were recovered.

It is submitted that Ashraf has already been enlarged on bail. The petitioner is in jail since 06.02.2015. The petitioner has already remained in jail for more than five and half months and he has got no criminal antecedent.

No.24885 of 2015 (2) dt.20-07-2015 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri C. M. Kumar, learned Judicial Magistrate, 1st class, Masaurhi in Kadirganj P.S. Case No. 99/2014, G. R. No. 1180/2014.
