The petitioners are apprehending their arrest in connection with Deepnagar P.S. Case No. 108 of 2016 registered for offences punishable under sections 147, 148, 149, 323, 341, 448, 302 and 504 of the Indian Penal Code.
Petitioners are named in the FIR. Allegation against the petitioners along with other accused persons is that they have assaulted the deceased by various arms.
It has been further submitted on behalf of the petitioners that there is general and omnibus allegation against the petitioners who are ladies and during investigation it has come about allegation of assault on some other accused persons and
Patna High Court Cr.Misc. No.8960 of 2017 (6) dt.20-04-2017 altercation took place due to love affair between the daughter of deceased and son of the accused persons and due to that altercation took place.
Heard learned A.P.P. also.
The allegation is general and omnibus in nature. Considering the fact that the petitioners are ladies, let the petitioners (1) Mano Devi; (2) Khusboo Devi; and (3) Munni Devi in the event of arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 108 of 2016; subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
With following conditions:
(i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned court;
(ii) The petitioners will not induce any witness or tamper with the evidence; and (iii) The petitioners shall co-operate in the investigation of the case and make themselves
Patna High Court Cr.Misc. No.8960 of 2017 (6) dt.20-04-2017 available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of their bail bond.
