ANJANA MISHRA ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 11.09.2018 in connection with Naya Ram Nagar P.S. Case No. 135 of 2018 (G.R. No. 1785 of 2018) registered for the offence under Sections 304(b)/34 of the Indian Penal Code.
Petitioner is husband of the deceased.
Learned counsel for the petitioner submits that the entire case is false and mischievous. In fact the victim lady got burnt while cooking her meals and the mother-in-law and brother-in-law have been extended the privilege of bail by this Court. It is further submitted that there was nothing on record to show that they have demanded dowry.
However, considering the facts that the petitioner is
Patna High Court CR. MISC. No.53606 of 2019(3) dt.30-09-2019 2/2 husband and the alleged occurrence taken place in connection with demand of dowry, I am not inclined to grant bail to the petitioner.
It is accordingly, rejected.
