The petitioner is in custody in a case registered under Section 302 and other allied Sections of the Indian Penal Code. The prosecution case in, brief, is that on 11.3.15 the informant and other police personnel was in the premises of police station, about 40-50 people forcibly entered in the police station and on the meantime thousand miscreants came there and started to breaking the articles of the police station and . They assaulted the police personnel. The miscreants threw Chaukidar in the fire. Several arms and other articles were burnt. They took away the articles and cash Rs. 14,000/- from the police station. It has been submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.26011 of 2015 (2) dt.24-07-2015 2/2 petitioner is in custody since 13.3.2015 and charge sheet has been submitted in this case. As per FIR 50 persons have been made accused. No specific overt act has been attributed against the petitioner. It is also submitted that general and omnibus allegation has been made against the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Buxar, in Industrial P.S.Case No. 32/2015.
