The petitioner apprehends his arrest in a case registered for offences punishable under Sections 420, 175 and 409 of the Indian Penal Code.
It is contended on behalf of the petitioner that he took charge from previous Panchayat Secretary, namely, Lalan Ram, on 3.11.2014 and 24.11.2014. It is urged that the documents of the charge has been given vide Annexure 2 in which there are signatures of the petitioner as well as previous Panchayat Secretary. Such documents were provided to the concerned officer. It is also submitted that after posting of the petitioner on
Patna High Court Cr.Misc. No.31263 of 2016 (2) dt.11-08-2016 2/2 the post of Panchayat Secretary in the year 2014, no body has been appointed at the post of Panchayat Shikshak and Panchayat Shikshaks were appointed prior to joining of the petitioner on such post.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Radhe Shyam Ram be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Rohtas (Amjhore) P.S. Case No. 42 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, J.M. 1st Class, Dehri subject to the conditions as laid down under sub-section(2) of Section 438 of the Code of Criminal Procedure.
