The petitioner filed this petition for modification of the order dated 05.04.2016 passed in Cr. Misc. No. 13309 of 2016 and prayed to extend the period of his surrender before the court below for four weeks from today.

The petitioner was granted anticipatory bail vide order dated 05.04.2016 with a direction that in the event of his arrest or surrender before the court below within four weeks from the date of receipt/production of a copy of the order the petitioner shall be released on anticipatory bail in Sitamarhi SC/ST P.S. Case No. 36 of 2015.

It is submitted that the petitioner is a teacher and he was engaged in election duty and had to undergo training to conduct peaceful Panchayat election.

No.30876 of 2016 (2) dt.16-09-2016 2/2 Considering the facts aforesaid and the fact that the petitioner could not surrender in time, this modification petition is allowed to the extent that if the petitioner above named surrenders before the court below within a period of three weeks from today, he shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in Sitamarhi SC/ST P.S. Case No. 36 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and other terms and conditions of the order dated 05.04.2016 passed in Cr. Misc.
