JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-364A, 302, 201/34 of the Indian Penal Code. Petitioner is not named but in course of investigation, his name surfaced in this case and it came to light that he was in constant touch with FIR named co-accused Ashish Kumar, who disclosed that the petitioner had given his motorcycle for committing the alleged occurrence. The motorcycle of the petitioner was seized but even if, the aforesaid fact assumed to be true, then also, according to prosecution case, only motorcycle of the petitioner has been used in committing the present crime. Considering the above-said facts and circumstances of

No.31632 of 2016 (2) dt.16-08-2016 2/2 the case as well as submission of the parties and also taking note of this fact that the petitioner does not have any criminal antecedent and is languishing in jail custody since 05-05-2016, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ekangarsarai P.S. Case No. 65 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Hilsa, Nalanga.
