2. The petitioner seeks regular bail in Deo P.S. Case No. 154 of 2024 registered for the offence punishable under Section-30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

3. Allegedly, 65 litres of illegal country-made liquor is said to have been recovered from three motorcycles. The petitioner is said to be owner of one of the motorcycles.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted that nothing incriminating has been recovered from conscious possession of

Patna High Court CR. MISC. No.64598 of 2024(2) dt.12-09-2024 2/2 the petitioner. It has next been submitted that no independent witness has supported the case of the prosecution. The petitioner is under incarceration since 21-07-2024.

5. Learned APP has opposed the prayer for bail and submitted that the petitioner has got criminal antecedent of one another case.

6. Considering the aforesaid facts and circumstances, specially, the criminal antecedent, the petitioner named above, is directed to furnish bail bond after two months from today and on doing so, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise-I, Aurangabad in connection with Deo P.S. Case No. 154 of 2024 subject to the condition that the petitioner shall cooperate with the trial and make himself available as and when required by the court.
