ANJANA MISHRA ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 05.05.2019 in connection with Parasbigha P.S. Case No.90 of 2019 registered for the offence under Sections 25(1-B)A and 26 of the Arms Act.

It is submitted by the learned counsel for the petitioner that the alleged recovery was not from the conscious possession of the petitioner. It is also submitted that the pistol, which was alleged to have been recovered, was non-functional, which is evident from the report dated 22.06.2019 contained in Memo No.2885. He thus submits that in view of the fact that the petitioner has already been in custody for four months, he may be extended the privilege of
