ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.07.2019 in connection with Kundwa Chainpur P.S. Case No.104 of 2019 registered for the offence under Sections 272 and 273 of the Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were from the motorcycle and not from the conscious possession of the petitioner. The petitioner is not having any criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal

Case No.104 of 2019.
