JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 24-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The petitioner apprehends his arrest in connection with Budha Colony P.S. Case No. 272 of 2016, registered for the offences punishable under Sections 408, 418, 420/34 of the Indian Penal Code.

Allegedly, the petitioner being an employee in Balajee Education Pvt. Ltd being in collusion and conspiracy with co-accused, misappropriated funds of the company to the tune of Rs. 7,24,255/-.

Submission is of false implication and that the petitioner is ready to deposit 50 % of the alleged misappropriated

Patna High Court Cr.Misc. No.12253 of 2017 (3) dt.24-04-2017 2/3 amount of Rs. 7,24,255/- within 08 (eight) weeks and the rest half amount will be deposited in 06 (six) equal instilments in 06 (six) months.

The learned A.P.P. duly assisted by learned counsel for the informant opposes the prayer of pre-arrest bail by submitting that in the changed circumstances if the total amount of Rs. 7,24,255/- is deposited in favour of company Balajee Education Pvt. Ltd then the company will withdraw this case. It is further submitted that the petitioner has also filed a complaint case and that should also been withdrawn to which the learned counsel for the petitioner submits that he is ready to withdraw that complaint case also.

In the facts and circumstances as stated above, the petitioner abovenamed, in case of despite of 50% amount of Rs. 7,24,255/- within 08 (eight) weeks in the account of Balajee Education Pvt. Ltd and after production of receipt thereof, will be released on provisional bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Ritu Kumari, J.M. 1st Class, Patna, in connection with Budha Colony P.S. Case No. 272 of 2016 with conditions as laid down in section 438(2) of the Cr.P.C. and after deposit of rest 50% amount within six months in six equal

Patna High Court Cr.Misc. No.12253 of 2017 (3) dt.24-04-2017 3/3 installments, the provisional bail so granted shall be confirmed by the learned court below itself, failing which the bail granted to the petitioner shall be deemed to be cancelled.
