JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 The petitioner seeks regular bail in connection with S.Tr. No. 648/14 arising out of Ahiyapur P.S. Case No. 208 of 2013, registered for offences punishable under Sections 399, 402and 414 of the Indian Penal Code and Section 25 (1b)A/26(ii) and 35 of the Arms Act. Allegation as per F.I.R is that police on information that some miscreants were moving around near the SKMCH premises in front of S.B.I. A.T.M. armed with weapons, raided the place and apprehended the accused persons and on search of their persons different arms and ammunition were recovered and from the possession of the petitioner, one country made pistol and five live cartridges were recovered. Having heard both sides, considering the facts and circumstances of the case and the period of custody of the petitioner, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Muzaffarpur, in connection with S.Tr. No. 648/14 arising out of Ahiyapur P.S. Case No. 208 of 2013, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
