JUSTICE RAKESH KUMAR ORAL ORDER 17-08-2016 Heard Sri Sandeep Kumar, learned counsel, who was assisted by Sri Ajit Kumar, learned counsel for the petitioner and Sri Umeshanand Pandit learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 15.06.2016 in connection with Gandhi Maidan P.S. Case No.212 of 2016 registered for the offence under Section 420 of the Indian Penal Code and Sections 51 and 63 of the Copy Right Act, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner is a retailer and without his knowledge or his conspiracy, some articles allegedly prepared in the name of Usha Company were recovered and on the aforesaid allegation, the petitioner has been taken in custody. It was

He submits that the petitioner undertakes to take precaution in future, so that same occurrence may not happen. In view of undertaking given by the petitioner, nature of accusation and period of custody, let the petitioner, namely, Vikash Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Supriya Goswami, learned Judicial Magistrate, 1st Class, Patna in connection with Gandhi Maidan P.S. Case No.212 of 2016.
