Petitioner seeks bail in Chandramandih P.S. Case No. 107 of 2017 instituted for the offence under Section(s) 399, 402 Indian Penal Code, Sections 25(1-b)a, 26, and 35 of the Arms Act.

Counsel for the petitioner submits that prayer of bail of petitioner has been rejected by co-ordinate Bench of this Court vide order dated 07.05.2018 passed in Cr. Misc. No.27695 of 2018.The trial court was directed to expedite the trial. A report has been received from the Court below from which it appears that the charge has not been framed against the petitioner till date.

In the written report, it is alleged that one loaded

Patna High Court Cr.Misc. No.64275 of 2018(5) dt.18-12-2018 2/2 country made pistol and knife were recovered from the possession of the petitioner.

It has been further submitted that other co-accused has already been granted bail by this Court vide order dated 17.05.2018 passed in Cr. Misc. No. 23345 of 2018. Petitioner is in custody since 08.11.2017.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Jamui, in connection with Chandramandih P.S. Case No. 107 of 2017, subject to the condition that both the bailors shall be close relative of the petitioner.

Further, (i) the petitioner will remain present on each and every date of trial, (ii) His absence on two consecutive date(s) without any reasonable cause will make his bail bond liable to be cancelled, and (iii) the petitioner will not intimidate the witnesses in any way and will not hamper the trial.
