Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner is languishing in custody since 16.06.2016 in connection with Ahiyapur P.S. Case No. 245 of 2016 registered for offence under Sections 366A and 372/34 of the Indian Penal Code.

The prosecution story, in brief, is that the victim girl has been taken away by the petitioner and others for illegal purpose, but, in course of investigation it revealed that the victim girl got married with one Nagendra Rai.

It has been submitted on behalf of the petitioner that the charge sheet has been submitted in the case. There is no criminal antecedent against the petitioner and there is no allegation of tampering of the witness alleged against the petitioner. The victim girl has been examined under Section 164 of the Criminal Procedure Code where she has admitted to have got married with Nagendra Rai and she has already been released in favour of the said co-accused. The petitioner is said to be one of the associate of co-accused Nagendra Rai.

Patna High Court Cr.Misc. No.33708 of 2016 (3) dt.18-10-2016 On behalf of the State it has been submitted that the petitioner is named in the First Information Report. Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 245 of 2016 to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur.
