The petitioner apprehends his arrest in connection with Complaint Case No. 22C- 2 of 2014 registered under Section 47(a)(f) of the Bihar Excise Act.
The accusation is of recovery of 30 litres country made liquor in a plastic Jerkin and 10 earthen pots, each containing 20 K.G. Mahua Jawa, from the house of the petitioner. Learned counsel for the petitioner submits that while seizure is prepared on 13.11.2013 showing recovery of 30 litres country made liquor and 200 K.G. Mahua Jawa from the house of he petitioner but the Excise Inspector submitted the prosecution
Patna High Court Cr.Misc. No.13363 of 2017 (2) dt.25-04-2017 report on 07.02.2014 and thereafter cognizance has been taken on 27.10.2015. In fact, nothing was recovered from possession of the petitioner. Further submission is that petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Complaint Case No. 22C- 2 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
