JUSTICE SUDHIR SINGH ORAL ORDER 17-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 302, 504, 506 and 34 of the Indian Penal Code. Allegation against the petitioner is of throttling nine months old son of the informant.

It has been submitted on behalf of the petitioner that she is in custody since 7.7.2015. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is the grand-mother of the deceased child. Merely a suspicion has been raised against the petitioner. General and omnibus allegation has been made against all the family members. There is no eye witness to the alleged occurrence nor there is any circumstantial evidence to suggest her implication in the present case.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.33132 of 2016 (3) dt.17-09-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Amarpur P.S. Case no. 206 of 2015 (G.R. no 1452 of 2015).
