The petitioner seeks bail in a case registered for the offences punishable under Sections 395 and 397 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 04.06.2020, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that on 12.04.2020 at about 11.15 P.M., he and two other persons were plying the truck for transportation of goods, when they arrived near Bagulaha at Raniganj, some unknown persons blocked the road by a car and

Patna High Court CR. MISC. No.68018 of 2021(2) dt.20-04-2022 2/3 looted Rs.10,000/- and mobile from the informant. The criminals also looted Rs.10,000/- from another truck driver. Meanwhile, the police arrived and on seeing the patrolling team, the accused persons fled away. It is further alleged that later the car was found and one Prasadi Mukhiya, who was present at the place of occurrence disclosed the name of five accused persons along with the petitioner and during search of the said car, some identity cards and number plates were also seized. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. His name transpired in the statement of Prasadi Mukhiya with whom the petitioner is on an inimical term. It is further submitted that similarly situated co-accused Navneet Kumar @ Navneet Yadav has been granted bail by order dated 17.06.2021 in Cr. Misc. No.13021 of 2021.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and the car did not belong to the petitioner and co-accused has been granted bail, the petitioner, abovenamed, is directed to be released on bail on his furnishing bailbonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with
