The petitioner seeks bail in a case instituted under Sections 363, 364/34 of the Indian Penal Code and later on, Section 302/201 of the Indian Penal Code has been added. The prosecution story, in brief, is that the F.I.R. named accused persons including this petitioner called the father of the informant on one pretext or the other and thereafter the father of the informant did not return.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.03.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The
Patna High Court Cr.Misc. No.32883 of 2016 (4) dt.21-10-2016 2/2 petitioner has falsely been implicated in the present case. There is no eyewitness to the alleged occurrence. No offence under section 364 of the Indian Penal Code is made out against the petitioner. The other co-accused persons have been granted bail vide Cr. Misc. No. 41617 of 2016 and Cr. Misc. No. 39007 of 2016 by another co-ordinate Benches of this court.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P.S. Case No. 18 of 2016.
