In this case, the petitioner is seeking anticipatory bail in connection with Bettiah (T) P.S. Case No.599 of 2016, registered for the offence punishable under Sections 409, 419, 420, 467, 468 and 471 of the Indian Penal Code. As per the allegation, the Bank Manager has received a complaint from one Biirendra Das, making allegation that Abhinaw Kumar has fraudulently created the Aadhar Card pasting his photograph and withdrawn the money from his account. During inquiry, it was found that he has also withdrawn the money from the account of Kabita Srivastava. He himself
Patna High Court Cr.Misc. No.22493 of 2017 (4) dt.19-08-2017 2/2 stated before the police that with the help of the present petitioner, who happens to be the nephew of Kabita Srivastava, has created fraudulent document and withdrawn the money and divided the same in two equal parts.
Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. If the petitioner surrenders before the Court below within three weeks from today and prays for bail, the court below will pass the order in accordance with law without being influenced by the order of this Court. While considering the bail application of the petitioner, the court below will consider the fact that Abhinaw Kumar has been granted bail. (Shivaji Pandey, J) pawan/- U T
