JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 20(b), 22(C) of the N.D.P.S. Act.

There is recovery of 1.830 Kgs of ganja, 309 pieces of cigarette like substance was recovered from the grocery shop of the petitioner.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner.

Patna High Court CR. MISC. No.56442 of 2022(4) dt.17-02-2023 2/2 Moreover, the seized contraband is under the commercial quantity. The petitioner is languishing in custody since 04.07.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Special (NDPS Act) Judge, Purnea in connection with K. Hat(Madhubani TOP) P.S. Case No. 574 of 2021 (Suppl. Special (NDPS Act) Case No. 51 of 2021/CIS No. 43 of 2022.
