Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Chanpatia P.S. Case No. 34 of 2022 lodged under Sections 304B/34 of the I.P.C.

As per the prosecution case, the allegation under Sections 304(B)/34 is against the petitioner, who is the husband of the deceased.

Learned counsel for the petitioner submits that the said occurrence took place only due to the reason that the deceased committed suicide.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.56306 of 2022(3) dt.21-02-2023 2/2 petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 23.01.2022. Learned counsel for the State opposes the prayer for bail and submits that petitioner is accused under Section 304(B)/34 and provision of law under Section 304(B) is different as that of Section 302.

In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.

With this observation, the bail application stands rejected.

Court is directed to expedite the trial and complete it within 9 months.
