JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2023 The present petition has been filed by the petitioner for extending the time granted to him for surrendering before the learned court below, vide order dated 22.05.2023, passed in Criminal Miscellaneous No. 57147 of 2022.

The learned counsel for the petitioner has submitted that on account of illness, the petitioner could not surrender within the time frame prescribed by this Court by the aforesaid order dated 22.05.2023, hence, four weeks further time be granted for the purposes of surrendering before the Ld. Trial Court and being admitted to the privilege of provisional bail. 3.

Having regard to the facts and circumstances of the case, considering the averments made in the present petition and

No.60464 of 2023(2) dt.08-09-2023 2/2 taking into account the submissions of the learned counsel for the petitioner, I deem it fit and proper to extend the time granted to the petitioner, by this Court by an order dated 22.5.2023, by a further period of four weeks, for the purposes of surrendering before the learned Court of Additional Chief Judicial Magistrate-1st, Bhojpur at Ara, in connection with Jagdishpur P.S. Case No. 294 of 2020 and availing the privilege of provisional bail.

The present petition stands allowed with the aforesaid modification in the order dated 22.5.2023 passed in Criminal Miscellaneous No. 57147 of 2022.
