The petitioner being husband of the victim is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code and section 3(2) (v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

It is alleged that the petitioner after kidnapping the daughter of the informant performed marriage on 03.08.2014 and, subsequently, she was killed.

It is submitted by learned counsel for the petitioner that the victim died due to illness and she was given medical assistance, his death certificate was issued by Manav Arogya Hospital, Vaishali on 03.08.2014 and considering the same

Patna High Court Cr.Misc. No.25305 of 2015 (2) dt.13-07-2015 2/2 other co-accused namely, Kiran Devi has been granted anticipatory bail by a co-ordinate bench of this court. The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Patepur P.S. Case No.107 of 2014, pending before the Sub-Divisional Judicial Magistrate, Vaishali at Hajipur.

With the above observation, this application is, accordingly, disposed off.
