ANJANA MISHRA ORAL ORDER 29-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner being a Panchayat Sachiv is apprehending his arrest in Tekari P.S. Case No. 11 of 2015, registered for the offences punishable under Sections 419, 420, 467, 468 of the Indian Penal Code.

Learned counsel for the petitioner submits that on the basis of written report by the B.D.O., Tekari issued under the direction of the Officer on duty, confidential section, Collectorate Gaya, FIR was registered alleging therein that the Panchayat Mukhiya appointed one Rajni Kumari as Panchayat Teacher who was an imposter in place of the real person, that is one Divya Verma. So far as the petitioner is concerned, he is only a Panchayat Secretary

Patna High Court Cr.Misc. No.31564 of 2016 (3) dt.29-08-2016 2/2 assisting the Mukhiya in his day to day activities. Learned counsel for the petitioner further submits that the said Manju Kumari who was the Mukhiya has since been extended to anticipatory bail in Cr. Misc. No. 1510/2016 vide order dated 12.01.2016. Considering the aforementioned facts and circumstances and that the case of the petitioner stands on similar footing, let the petitioner in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Tekari P.S. Case No. 11 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Anjana Mishra, J.) Rakhi U T
