The petitioner apprehends his arrest in connection with Chowk P.S. Case no. 38 of 2017, registered under Sections 201, 120-B of the Indian Penal Code and under Section 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that on receiving the secret information about moving of notorious criminal, namely, Kundan Kumar Jaiswal, the Police reached at the house of Kundan Kumar Jaiswal, who was found in possession of pistol containing six live cartridges in the magazine along with two country made pistol and 23 live cartridges, who also confessed his guilt supplying the same by one Dipak Yadav and he also stated that this petitioner was with him on the motorcycle at Chowk in other occurrence.

Patna High Court Cr.Misc. No.20602 of 2017 (5) dt.03-08-2017 2/2 Learned counsel for the petitioner submits that petitioner has not been arrested by the Police and no incriminating articles were recovered from the possession of the petitioner. The name of the petitioner has been disclosed by co-accused Kundan Kumar Jaiswal in his confessional statement.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Patna City, Patna in connection with Chowk P.S. Case No. 38 of 2017 (G.R. 504/2017), subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
