Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This application for regular bail arises out of Kargahar (Barahari O.P. ) P.S. Case No. 172 of 2021 disclosing commission of offence punishable under Sections 365 and 34 of the Indian Penal Code.

The petitioner is a lady and the Mother-in-Law of the deceased. The deceased was married to the petitioner's Son according to the prosecution's case on 24.02.2014. The father of the deceased has alleged in his written report that when he attempted to talk to his daughter, the victim, her mobile phone

Patna High Court CR. MISC. No.63927 of 2022(2) dt.04-03-2023 2/3 was found switched off. With the allegation that from 6/7.07.2021, the victim was traceless, FIR came to be registered. Learned counsel appearing on behalf of the petitioner has submitted that her implication is only because she is mother of the husband of the deceased. He has further submitted that as chargesheet has been submitted there is no chance of any tampering with the evidence by the petitioner, if she is directed to be released on bail.

Learned counsel for the Informant opposing the prayer for bail has submitted that during the course of investigation, only two days after the lodging of the FIR, a witness has disclosed to the police about the death of the deceased when she was being taken in a SCORPIO vehicle on the date of occurrence in which this petitioner was also sitting. Based on the submissions advanced on behalf of the petitioner in the background of the nature of allegation made in the FIR, I am of the view that there is no direct allegation against the petitioner of her involvement in any manner in commission of the offence. This application is accordingly allowed.

Let the petitioner above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand), with two
