JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 392 of the Indian Penal Code.

It is alleged by the informant that while he was going to his Sasural on his Pulsar Motorcycle, three persons on motorcycle intercepted him near Kolhat Bandh and put the pistol on his motorcycle. One of them snatched two mobiles and Rs. 22,000/- from his pocket along with Voter ID and Aadhar Card and fled away towards Kolhat.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.05.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses

Patna High Court Cr.Misc. No.33618 of 2016 (4) dt.27-09-2016 2/2 alleged against the petitioner. The petitioner is not named in the FIR. The petitioner was apprehended on suspicion. There is no recovery of any incriminating article from the possession of the petitioner. Other co-accused has been granted bail by this Court on 20.09.2016 vide Cr. Misc. No. 33138 of 2016.

On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera in connection with Rosera P.S.Case No. 134 of 2016.
