JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given axe blow on the neck of the deceased of the present case.

Submission on behalf of the petitioner is that in course of trial, the eye witnesses have not supported the prosecution case and, therefore, petitioner should be released on bail but I am not convinced with the aforesaid submission as even if the aforesaid submission is assumed to be true, then also, it is obvious that the trial of the petitioner is going on in full swing and there is possibility of conclusion of trial of the petitioner in near future and, accordingly, his prayer for bail in connection with Session

Patna High Court Cr.Misc. No.31673 of 2016 (2) dt.16-08-2016 2/2 trial no. 32 of 2016, arising out of Madhepura ( Bharrahi) P.S.Case No. 162 of 2015, pending in the court of Additional Sessions Judge-III, Madhepura stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible.
