JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 323, 379 and 354/34 of the Indian Penal Code.

Allegation against the petitioners is to have assaulted the informant and also taken away her golden ornaments. It has been submitted on behalf of the petitioners that they have no criminal antecedents. F.I.R. was instituted three days after the occurrence for which no explanation has been given by the prosecution. Both parties are gotias. The present prosecution has been brought due to land dispute between the parties. The allegation made in the F.I.R. are general in nature. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on

Patna High Court Cr.Misc. No.39886 of 2015 (2) dt.01-10-2015 2 / 2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali, in connection with Vaishali P.S. Case no. 244 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
