For the Petitioner/s : Mr. Praveen Kumar, Advocate For the Opposite Party/s : Mr. Uma Nath Mishra (APP) ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 21-01-2015 The petitioner is being tried for the offences punishable under Sections 147, 148, 149, 120B, 122, 124A, 307 and 353 of the Indian Penal Code and some provisions of the Arms Act. The petitioner was arrested on 16.10.2013. He filed B.P. No.671 of 2013 in the Court of Additional Sessions Judge, IV, Gaya for bail. The same was dismissed on 01.04.2014. Hence, this application before this Court.
Heard learned counsel for the petitioner and learned counsel for the State.
The allegation against the petitioner is indeed serious. It is stated that the police received confidential information and proceeded towards Asurain forest where the accused are said to have concealed considerable quantity of arms and ammunitions. In addition to that, the petitioner is made an
Patna High Court Cr.Misc. No.23507 of 2014 (4) dt.21-01-2015 2/2 accused in seven cases.
Strictly speaking, the petitioner does not deserve any relief at this stage. However, taking into account, the fact that the investigation into the present case has already been completed, this Court intends to release the petitioner on bail subject to certain conditions.
Hence, this application is allowed. The petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Imamganj P.S. Case No.131 of 2013, on the condition that the petitioner shall report Imamganj Police Station between 9 A.M. and 10 A.M on the 1st and 3rd Sundays of every month. If he fails to report the concerned police station even once, his bail bond shall stand cancelled and he shall be liable to be arrested again.
