The petitioner seeks regular bail in connection with Daudnagar PS case no. 355 of 2017 registered for the offence punishable under Sections 302, 120(B)/34 of Indian Penal Code.
The case of the prosecution is that the son of the informant had gone outside the house towards the village, however he did not return in the night and in the morning, it transpired that the son of the informant had been killed and his dead body was lying beneath the bridge over the canal. The learned counsel for the petitioner has submitted that the FIR has been lodged against unknown
Patna High Court Cr.Misc. No.69333 of 2018(3) dt.09-01-2019 2/2 persons and the petitioner has been implicated in the present case merely on the basis of suspicion. It is further submitted that there is no material in the case diary to connect the petitioner with the alleged crime as well as there is no evidence to suggest that even the petitioner was last seen with the deceased prior to his alleged murder. Lastly, it is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 16.07.2018.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Daudnagar (Aurangabad) in connection with Daudnagar PS case no. 355 of 2017.
