JUSTICE BIBEK CHAUDHURI ORAL ORDER 10-09-2024 A departmental proceeding was initiated against the petitioner on the basis of complaint made by one Subhadra Devi. The petitioner was suspended from his service w.e.f. 11th of April, 1996. Subsequently, he was submitted Memorandum of Charge. On the basis of Memorandum of Charge, show cause was submitted by the petitioner. The departmental proceeding concluded, holding the petitioner guilty for misconduct vide an order dated 28th of February, 2002 and the petitioner was dismissed from service. The petitioner challenged the said order by filing C.W.J.C. No. 3438 of 2002, which was disposed of on 19th of August, 2005, directing the petitioner to avail the

Patna High Court CWJC No.13301 of 2024(2) dt.10-09-2024 2/2 appellate remedy under the Bihar Police Manual. The petitioner then preferred an appeal before the Director General of Police, Bihar on 13th of September, 2005.

2. It is the grievance of the petitioner that till date the said appeal has not been disposed of.

3. Under the facts and circumstances stated above, the instant writ petition is disposed of directing the Respondent No. 2 (The Director General of Police, Government of Bihar, Patna) to dispose of the appeal filed by the petitioner in the year 2005 against the order of dismissal passed by the disciplinary authority on 28th of February, 2022 within 60 days from the date of communication of this order.

4. With the above direction, the instant writ petition is disposed of.
