====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 23-03-2023 Heard learned counsel for the petitioner, learned counsel for the opposite party no.2 and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Complaint Case No.752 of 2021 registered under Section 498(A) of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner a poor farmer and out of his earnings from agricultural work, he is ready to pay Rs.2000/- per month to the complainant/opposite party no.2 (wife) as maintenance. In

Patna High Court CR. MISC. No.59377 of 2022(3) dt.23-03-2023 2/2 support thereof, a supplementary affidavit has been filed. The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Judicial Magistrate, 1st Class, Kaimur (Bhabua) in connection with Complaint Case No.752 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
