The present application has been filed for modification of the order dated 10.08.2015, passed in Criminal Miscellaneous No.32437 of 2015 to the extent of confirming the provisional bail.

The petitioner was granted provisional anticipatory bail for six months considering the accusation of assault being not being specific against him, vide order dated 10.08.2015, passed in Criminal Miscellaneous No.32437 of 2015 in connection with Rosera P.S. Case No.132/2014, pending before the learned Additional Chief Judicial Magistrate, Rosera, Samastipur, instituted for the offences punishable under sections 147, 148, 149, 341, 323, 324, 307, 504 and 379 of the Indian Penal Code, but it appears that inadvertently the conditions for confirmation of provisional anticipatory bail could not be recorded in the order

Patna High Court Cr.Misc. No.20855 of 2017 (2) dt.10-05-2017 2/2 aforesaid.

It is submitted by learned counsel for the petitioner that the petitioner is still on anticipatory bail and his bail bond has not been cancelled till date, though statement to that effect has not been made in the petition.

In the circumstances, the order dated 10.08.2015, passed in Criminal Miscellaneous No.32437/2015 is modified to the extent that the provisional anticipatory bail granted to the petitioner is hereby confirmed, if the bail bonds furnished by the petitioner have not been cancelled as yet.
