The petitioners seek bail in connection with Excise Case No. 293 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioners submits that the petitioners are in custody since 07.10.2021, are persons with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioners submits that the allegation is of recovery of 83.520 litres of liquor from a Tata

Patna High Court CR. MISC. No.68493 of 2021(2) dt.25-02-2022 2/2 Magic.

Learned counsel for the petitioners submits that the petitioners are driver and khalashi of the aforesaid Tata Magic and as such were not aware what was loaded in the vehicle by the owner of the vehicle.

Learned A.P.P. for the State opposes the prayer for bail of the petitioners.

Considering the fact that the petitioners are in custody since 07.10.2021, are persons with clean antecedent and prosecution report has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 1,000/- (Rupees One Thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Gopalganj in connection with Excise Case No. 293 of 2021.
