====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 28-08-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Teghra P.S. Case No. 31 of 2019 registered under section 366 of the Indian Penal Code.
The allegation against the petitioner is that he abducted the daughter of the informant Bibha Kumari. Learned counsel appearing for the petitioner submits that petitioner is innocent and has not committed any offence in the manner alleged. Learned counsel further submits that both the parties belong to the same village. Learned counsel relying upon the statement made under Section 164 Cr.P.C. of the victim girl annexed at Annexure-2 submits that the statement of
Patna High Court CR. MISC. No.53927 of 2019(2) dt.28-08-2019 2/2 the girl has been recorded in which she has not said anything against the petitioner except that the petitioner abducted her on gun point.
After having heard learned counsel for the parties and taking into consideration the fact that from the perusal of the statement of the girl recorded under Section 164 of Cr.P.C., it is evident that the petitioner had abducted a minor girl aged about 12 years on the gun point, I am not inclined to exercise my discretion to grant anticipatory bail.
This application is, accordingly, dismissed.
