JUSTICE MOHIT KUMAR SHAH ORAL ORDER 30-11-2022 The present writ petition has been filed seeking the following reliefs:- "1.I. To issue writ/writs, order/orders, direction/directions including a writ in the nature of Mandamus directing the Respondents for removing the encroachment upon the land Anabad Bihar Government Land, which has been encroached by making a hut upon the said land by the Respondent no.7 to 9, the residential land of the petitioner having Thana No. 199, Khata No. 29, Plot No. 148 and Rakba 6.25 decimals, which has been purchased by Dulhin Bhagirathi Devi for purpose of the house for which his way of exit is encroached by the Respondent No. 7 to 9.

To issue writ/writs, order/orders, direction/directions including a writ in the nature of Mandamus directing the Respondent Circle Officer, Kargahar, Rohtas to pass an appropriate order in encroachment matter and considering an application submitted by the petitioner and passed the order regarding the land encroached by the Respondent No. 7 to 9 of Anabad Bihar Government Land."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Kargahar, District-Rohtas, for redressal of his aforesaid grievance. Liberty so sought is granted.

It is needless to state that in case the petitioner approaches the Circle Officer, Kargahar, District-Rohtas, by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.

The writ petition stands disposed off on the aforesaid terms.
