2. The petitioner seeks regular bail in connection with Gopalpur P.S. Case No. 95 of 2024, registered for the offence under Sections 341, 323, 354 (A), (B) (C) & (D) of the Indian Penal Code and section 8 & 12 of the POCSO Act.
3. As per the prosecution case, the petitioner is accused of eve teasing and threatening the victim.
4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. There is land dispute between the parties. Petitioner has clean antecedent and he is in custody since 30.06.2024.
5. Learned A.P.P. has vehemently opposed the
Patna High Court CR. MISC. No.67217 of 2024(2) dt.25-09-2024 2/2 prayer for bail.
6. Considering the facts and circumstances of the case and also considering the period of custody, this application for regular bail is allowed.
7. Let the petitioner above named, be granted bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned 6th Addl. Sessions Judge, West Champaran, Bettiah in connection with Gopalpur P.S. Case No. 95 of 2024, subject to the condition that the petitioner will mark his attendance at Gopalpur Police Station on first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. (Sandeep Kumar, J) Ranjeet/- U T
