JUSTICE RAJIV ROY ORAL ORDER 06-02-2023 Heard learned counsel for the petitioner and the learned APP for the State The petitioner apprehends his arrest in connection with Bhorey P.S. Case No.76 of 2014 instituted under Sections 420,406 of the Indian Penal Code.
The prosecution story that was lodged in 2014, the complainant alleged that the petitioner in collusion with the other accused persons in the garb of sending him abroad usurped Rs.90,000/- as also Rs.15,000/- in the name of medical expenses and later he realized that he has been duped. Accordingly, the complaint.
Learned counsel for the petitioner submits that he was serving in 'Kuwait' and had no role to play in the matter. Learned APP on the other hand submits that he was the mastermind in the entire work and a complaint that was filed
Patna High Court CR. MISC. No.58301 of 2022(2) dt.06-02-2023 2/2 in 2014, he chose to finally prefer this petition eight years later and in that background he has opposes the prayer for anticipatory bail.
Taking into account the aforesaid allegation that has come against which petitioner as also the conduct of having hampered the conclusion of the trial due to his disappearance for the last nine years, no relief can be extended to him, the petition stands rejected.
