2. This application has been filed for modification of condition '(v)' mentioned in Paragraph 6 of the order dated 04.07.2025 passed in Cr. Misc. No. 42047 of 2025 by this Court, whereby the petitioner was granted bail.
3. Learned counsel appearing on behalf of the petitioner submits that in view of the conditions as contained in Paragraph 6 (v), the bail bonds of the petitioner were not accepted, as inadvertently in Paragraph 3 of the main bail application it has been stated that the petitioner carried five
Patna High Court CR. MISC. No.57571 of 2025(2) dt.22-08-2025 2/2 criminal antecedents instead of six criminal antecedents.
4. The learned counsel for the petitioner submits that in view of such a condition, despite bail being granted to him, he could not have been released.
5. The aforesaid bail application bearing Cr. Misc. No. 42047 of 2025 was allowed with the particular condition stated therein:
"6 (V) The learned court below shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned".
6. In view of such a condition, it was mandatory upon the petitioner to come out clean in stating the antecedent, and as such the present application stands dismissed.
7. The petitioner is directed to move this court afresh with a prayer for bail.
