JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 419, 420, 506, 469, 471, 500, 501, 153A ad 295 of the Indian Penal Code and 66 (B), 66(C) and 66(D) of the I.T. Act. Prosecution case, according to the informant, is that his party President's facebook page with Email ID and Facebook ID have been hacked by some unknown person and some objectionable materials have been posted with malicious intention. It has been submitted on behalf of the petitioner that he is in custody since 19.4.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent.
No allegation of tampering of witnesses is alleged against the petitioner. Chargesheet has been submitted under Sections 419, 469, 471 and 501 of the Indian Penal Code, which are bailable and also under Sections 66(B), 66(C) and 66(D) of the I.T. Act. Petitioner is not named in the F.I.R. It is further submitted that petitioner may be released after completion of six months in custody, i.e., from 19.4.2016.
On behalf of the State, it is submitted that petitioner is not named in the F.I.R.

No.33319 of 2016 (3) dt.22-09-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail after completion of six months in custody, i.e., from 19.4.2016 on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Sachivalaya P.S. Case no. 23 of 2016.
