In this case, the petitioner is seeking anticipatory bail in connection with Morkahi P.S. Case No.138 of 2016, registered for the offence punishable under Sections 409 and 420 of the Indian Penal Code.

The petitioner was the headmaster during the Financial Year 2010-11 and he was given Rs.6,32,000/- for construction of middle school building, but the construction could not be completed.

Learned counsel for the petitioner submits that the petitioner has already returned an amount of Rs.1, 40,000/- and if there is any outstanding dues, he is ready to return the same.

Patna High Court Cr.Misc. No.25065 of 2017 (2) dt.13-07-2017 In view of the statement made by learned counsel for the petitioner, let the petitioner- Dharmendra Sada, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Khagaria, connection with Morkahi P.S. Case No.138 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. Let the Block Development Officer furnish the details of outstanding dues, which the petitioner would pay within one month from the date of receipt of detail of outstanding dues, failing which, this order will be treated to have been withdrawn.
