This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 341, 323, 384, 467, 468 and 420 of the Indian Penal Code and 27 of the Arms Act. For land dispute allegation against the petitioner is that he demanded ransom from the informant. The impugned order reveals that other co-accused have been allowed bail and prayer for anticipatory bail has been refused to the petitioner on that allegation. Submission of the petitioner is that the Court below did not consider that there is land dispute between the parties and in the aforesaid background it can not be said that the petitioner really demanded any ransom,
Patna High Court Cr.Misc. No.20712 of 2017 (2) dt.11-05-2017 2/2 which is a criminal act affecting the society at large. Considering the background of allegation, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Katihar Town P.S. Case No. 109 of 2017 to the satisfaction of the Chief Judicial Magistrate, Katihar, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
