Petitioners, who are in custody, seek bail in connection with Bhore P.S. Case No. 206 of 2018 registered for the offences punishable under Sections 341, 323, 325, and 302/34 of the Indian Penal Code.
Informant has alleged in his written complaint that his elder brother Kishor Ram and his wife Sarita Devi were assaulted by petitioner Lalji Ram, Binda Devi wife of lali Ram , Bablu Kumar and Jaiprakash Ram sons of petitioner as a result of which his elder brother died and hand of his sister-in-law got fractured. It has been further alleged that Jyoti Kumari and Ramayan Singh also help the accused in committing said crime. It has been submitted on behalf of the petitioners
Patna High Court Cr.Misc. No.66308 of 2018(4) dt.11-01-2019 2/2 that allegations against them are general and omnibus in nature. There is no specific allegation of any over act against the petitioners. Petitioners have no criminal antecedent and are 01.07.2018. in custody since 04.07.2018 and 01.07.2018 respectively.
Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XII, Gopalganj, in connection with Bhore P.S. Case No. 206 of 2018, subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioners shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by Court and his absence on two consecutive dates without sufficient reasons, their bail bond shall be cancelled by the court below.
(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
