The petitioner seeks regular bail in connection with Lakhisarai P.S.Case No.461 of 2017 registered for offences punishable under Sections 302,34,1 20(B) of the Indian Penal Code and Section 27 of the Arms Act.

From the FIR it appears that the deceased had land dispute with the petitioner and others and they were asking the deceased to leave the land otherwise to face the consequences and it is stated that the petitioner and other two accused persons had conspired together and killed his father by firing on him. Submission of the learned counsel for the petitioner is that no specific allegation has bee attributed against the petitioner and only because of the land dispute, a suspicion has

He is in custody since 6.8.2018 learned A.P.P. also, who has drawn my attention towards para nos. 8.9, and 22 of the case diary that the witnesses have stated against the accused persons but he could not point out any specific allegation against the petitioner. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Lakhisarai in connection with Lakhisarai P.S.Case no.461 of 2017. With the aforesaid observation, this application is allowed.
