====================================================== CORAM: HONOURABLE MR. JUSTICE RUDRA PRAKASH MISHRA ORAL ORDER 08-09-2025 Heard learned counsel for the petitioners and learned APP for the State as also learned counsel for the informant.
2. The petitioners seek bail in connection with Sasaram (M) P.S. Case No. 196 of 2025 instituted for the offences under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 352, 351(2), 281, 326(f) of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act.
3. As per prosecution case, the accused persons including the petitioners have assaulted the informant and others.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence as
Patna High Court CR. MISC. No.59351 of 2025(2) dt.08-09-2025 2/3 alleged against them and have falsely been implicated in the present case due to previous enmity. There is no specific or direct allegation of any overt act against the petitioners rather the same is general and omnibus in nature. There is a case and counter case between the parties. In the alleged occurrence, both the parties have sustained injuries. He further submits that the informant and his family members assaulted Shiv Prasan Ram and he lodged Sasaram (M) P.S. Case No. 197 of 2025 for this and, as a counter blast, the informant lodged the present false case. The petitioners have no criminal antecedent and are languishing in judicial custody since 12.06.2025 without any rhymes or reason.
5. Learned counsel for the petitioners again submits that the co-accused have been granted bail by a Co-ordinate Bench of this Court vide order dated 27.08.2025 passed in Cr. Misc. No. 58379 of 2025.
6. On the other hand, learned A.P.P. for the State and the informant have vehemently opposed the prayer for grant of bail to the petitioners.
7. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioners
Patna High Court CR. MISC. No.59351 of 2025(2) dt.08-09-2025 3/3 and the petitioners having no criminal antecedent, let the petitioners, abovenamed, be released on bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Sasaram (M) P.S. Case No. 196 of 2025.
