JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2018 Petitioner prays for bail in connection with K. Hat (Madhubani) P.S.Case No. 282 of 2018 registered for the offences punishable under Sections 461, 379 and 411 of the Indian Penal Code.
Allegation is of committing theft of cash and articles in UCO Bank and petitioner is not named in the FIR. Later on it appears that some cash has been recovered from the possession of the petitioner.
Submission of learned counsel for the petitioner is that he has falsely been implicated in this case, having no criminal antecedent and he is in custody since 29.5.2018. Further submission is that similarly situated co-accused persons
Patna High Court Cr.Misc. No.63060 of 2018(4) dt.27-11-2018 2/2 have been granted bail by co-ordinate Bench of this Court vide order dated 8.10.2018 in Cr.Misc.No. 55810 of 2018 and vide order dated and vide order dated 25.10.2018 in Cr.Misc.No. 64162 of 2018.
Heard learned APP and learned counsel for the UCO Bank.
Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, in connection with K. Hat (Madhubani) P.S.Case No. 282 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
