The petitioner is apprehending his arrest in connection with Maranchi P.S. Case No. 23 of 2017 for the offences punishable under Section 30(a) of the Bihar Excise Act, 2017 Co-accused Raj Mahto was apprehended while he was carrying foreign liquor on a pick-up van. Raj Mahto disclosed that he was carrying the same from Deoghar to Muzaffarpur to supply the same to Vipul Ji. He further disclosed that this petitioner had asked the owner of the pick-up van to take the services of the Raj as driver.
Submission of the learned counsel for the petitioner is that there is no accusation against the petitioner that he was
Patna High Court Cr.Misc. No.22322 of 2017 (3) dt.04-07-2017 2/2 involved in the sale of the recovered liquor. He further submits that giving some assignment to some one for livelihood is no offence alleged against the petitioner.
Let, the petitioner, above named, in the event of his arrest or surrender the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court below/Successor Court in connection with Maranchi P.S Case No. 23 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. With further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
