The petitioner apprehends his arrest in Nautan P.S. Case No. 439 of 2017 registered for the offence under Sections 414/34 of the Indian Penal Code and Section 30(a), 36 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case total 15 liters of country made liquor was recovered from the motorcycle. It is submitted on behalf of petitioner that petitioner has clean antecedent and has committed no offence and he has falsely been implicated in the present case. He further submits that nothing has been recovered from conscious possession of the petitioner. It is further submitted that he has no concern with the seized article or vehicle in question and petitioner is not the

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Nautan P.S. Case No. 439 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
